Welcome to Spotter. By downloading, accessing, or using the Spotter mobile application (the "App"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you must not use the App.

1. Eligibility

You must be at least 18 years old to use the App. If you are under 18, you may only use the App with the involvement and consent of a parent or legal guardian.

2. Medical and Health Disclaimer

SPOTTER IS NOT A MEDICAL PROVIDER AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

Always consult a qualified healthcare professional before beginning any exercise program, fitness routine, or dietary change.

Participation in physical activity involves inherent risks, including serious injury, illness, or death. You voluntarily assume all risks associated with your use of the App and any workout recommendations generated by the App.

The App is not intended for emergency or urgent medical situations. If you believe you are experiencing a medical emergency, contact emergency services immediately.

3. AI-Generated Content

Spotter uses Artificial Intelligence ("AI") to generate personalized workout recommendations based on information provided by users.

  • AI-generated recommendations may contain errors, omissions, inaccuracies, or unsuitable suggestions.
  • The App does not guarantee the accuracy, safety, effectiveness, or suitability of any AI-generated workout plan.
  • You are solely responsible for determining whether any exercise, workout, weight, intensity level, or recommendation is appropriate for your physical condition and fitness level.
  • You should independently evaluate all recommendations before acting on them.
  • You must immediately stop exercising and seek professional medical advice if you experience pain, dizziness, injury, or unusual discomfort.

4. User Accounts

You agree to provide accurate and complete information when creating an account and to keep your information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You may delete your account and associated data within the App from the Coach section, or by contacting us.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used improperly, unlawfully, or in a manner that may harm the App, its users, or third parties.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose.
  • Attempt to reverse engineer, decompile, or otherwise extract the source code of the App except where permitted by applicable law.
  • Interfere with, disrupt, or compromise the security or functionality of the App.
  • Use automated systems or bots to access the App without authorization.
  • Misrepresent your identity or provide false information.

6. Intellectual Property

The App and all related software, designs, trademarks, logos, content, and materials are owned by Spotter or its licensors and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, or create derivative works based on the App.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, store, and protect personal information.

8. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.

We do not warrant that the App will be uninterrupted, error-free, secure, or that any defects will be corrected.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Spotter, its developers, affiliates, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, business interruption, or other intangible losses arising out of or relating to your use of the App.

To the maximum extent permitted by applicable law, Spotter shall not be liable for injuries, losses, or damages resulting from the use of AI-generated workout recommendations, exercise plans, or fitness guidance provided through the App.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts of Finland, except where mandatory consumer protection laws provide otherwise.

11. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the App or by updating the Effective Date above.

Your continued use of the App after any changes become effective constitutes acceptance of the updated Terms.
